“FOREST-ONE EGGER RESPONSIBLE SPECIFIER” PROMOTION

TERMS AND CONDITIONS

 

  1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is only open to individuals aged 18 years and over who are professional building specifiers in Australia (i.e. interior designers, designers, architects, cabinet makers, shop fitters, furniture makers, build and construct, etc) with an ABN.
  3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  4. Entries into the promotion open on 01/04/23 and close at 11:59pm AEDT on 31/01/24 (“Promotional Period”).
  5. To be eligible to enter, individuals must either:
    1. develop a building plan including material schedule(s) that feature a ForestOne EGGER product specification; or
    2. complete a construction project which features ForestOne EGGER specifications.

    (each an “Eligible Project”).
    For clarity, if an Eligible Project has been changed after entry submission so that the project no longer features ForestOne EGGER specifications, the entry will be deemed invalid.  Additionally, material schedule(s) must originate with the entrant – if a material schedule submitted by an entrant does not originate with the entrant (i.e. the material schedule has been given to the entrant), the entry will be deemed invalid.

  6. To enter, eligible individuals must then visit www.specified-responsibly.com and follow the prompts to the promotion entry page, input the requested details; upload the plan including the material schedule(s) or a completion photo of the Eligible Project and submit the fully completed entry form during the Promotional Period.  Additionally, for any Eligible Project submitted via a photo for a project already complete, the Promoter may request proof that the ForestOne EGGER specification was supplied by the Promoter – in the event that it is not, the entry will be deemed invalid.
  7. Multiple entries permitted, subject to the following: (a) each entry must be submitted separately and in accordance with entry requirements; and (b) each Eligible Project must be substantially unique (i.e. the same Eligible Project cannot be submitted more than once).
  8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  9. Incomplete, indecipherable or unviewable entries will be deemed invalid.
  10. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  11. There will be eleven (11) draws conducted for this promotion, consisting of ten (10) minor draws and one (1) major draw. Entries close for each draw at 11:59pm AEDT/AEST (as applicable) on the dates specified in the table below.  All draws will take place at Anisimoff Legal, Suite 5/210 Central Coast Hwy, Erina NSW 2250 on the dates specified in the table below at 12pm AEDT. Entries in each minor draw will NOT be entered into any subsequent draws.  Winners will be notified in writing within two (2) business days of the draw and published on www.specified-responsibly.com on the dates specified in the table below.

  12. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
  13. The Promoter’s decision is final and no correspondence will be entered into.
  14. The first two (2) valid entries drawn in each minor draw will each win a publicity package valued at up to AU$1,000.00.  Prize includes a profile by the Promoter’s media partner and free publicity for each winner’s design work.  The Promoter’s media partner will liaise with each winner to assess and provide an appropriate publicity package.
  15. Each winner in a minor will also be entered into the major draw, subject to the project submitted as part of the winner’s entry continuing to be an Eligible Project at the date of the major draw, in accordance with clause 5.
  16. The first valid entry drawn in the major draw will win a trip for two (2) adults to the Euro Cucina trade show valued at up to AU$7,500.00 depending on date and point of departure.  Prize includes:
    1. Two (2) x return economy airfares from winner’s nearest capital city to Germany, Austria, or Italy (final details to be confirmed by the Promoter based on proximity to the Euro Cucina trade show and booking availability);
    2. Three (3) nights twin share minimum 4-star accommodation; and
    3. Two (2) admission tickets to the Euro Cucina trade show held in 2024 set to take place in Milan, Italy – final details to be confirmed by the Promoter in advance of the trip;
    4. An optional tour for two (2) adults to an EGGER Design and Production Facility in Sankt Johann, Austria – final details to be confirmed by the Promoter in advance of the trip; and
    5. Return transfers from airport to hotel, from hotel to EGGER Design and Production Facility, and from hotel to Euro Cucina trade show.

    Spending money, meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken to coincide with the Euro Cucina 2024 trade show event.  The major prize winner is responsible for liaising with the Promoter’s affiliated travel agent, FBI Travel to book flights, which are subject to booking and flight availability.  The Promoter will provide the major prize winner with further details to facilitate the flight booking process.

    The winner and their companion are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation.  The winner and their companion must depart from and return to the same departure point and travel together. The winner and their companion can choose to upgrade their flight package at their own expense, but the major prize is otherwise not to be modified. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in.

  17. In the event of war, terrorism, state of emergency, pandemic, government lockdown or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority.
  18. The Euro Cucina 2024 trade show ticket and EGGER Design and Production Facility tour components of the major prize are subject to the event venue and ticket terms and conditions.  The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or their companion) for any inappropriate behaviour whilst participating in any element of the prize.
  19. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
  20. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  21. Total prize pool value is up to AU$27,500.00.
  22. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  23. A draw for any unclaimed prizes may take place on 08/03/24 at the same time and place as the major draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by email within two (2) business days of the draw and their names will be published on www.specified-responsibly.com from 11/03/24.
  24. Entrants agree that they are fully responsible for any materials they submit via the promotion including but not limited to comments, recordings and images (“Content”). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever. Entrants warrant and agree that:
    1. they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
    2. their Content shall not contain viruses or cause injury or harm to any person or entity;
    3. they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;
    4. the Content is the original work of the entrant that does not infringe the rights of any third party;
    5. they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and
    6. they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.

    Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.

  25. As a condition of entering this promotion, each entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.
  26. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  27. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  28. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
  29. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  30. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  31. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of / taking of a prize.
  32. The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.forest.one/privacy-policy.  In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with.
